1. What information we collect

We collect certain information from you directly, such as information you enter on your own, information about your content consumption, and information from third party platforms that you connect to Alpha Digital Academy. We also collect some data automatically, such as information about the user’s device and the parts of our Services that the user interacts with or spends time using.

1.1 Data You Provide to Us

We may collect different information from or about you depending on how you use the Services. Below are some examples to help you better understand the data we collect.
When you create an account and use the Services, including through a third party platform, we collect data that you provide directly to us, including:
Account Data In order to use some features (such as accessing content), the user needs to create a user account. When creating or updating the User’s account, we collect and store data that the User provides to us, such as email address, password, phone number, occupation, skill interests, gender, race, ethnicity, government-issued identification information, photo verification, age, date of birth and account settings, and assign the User a unique identification number (“Account Data”).
Profile Data You may also choose to provide profile information, such as a photo, title, biography, language, website link, social media profiles, or other information. The User’s Profile Data will be publicly visible to other users.
Shared Content Some parts of the Services allow the user to interact with other users or share content publicly, for example, by posting reviews of content, asking or answering questions, sending messages to students or instructors, or posting photographs or other work that the user uploads. Such shared content may be publicly visible to other users depending on where it is posted.
Educational Content Data When you access content, we collect certain data, such as courses, assignments, labs and exams you have started and completed; credits and purchases of content; subscriptions; certificates of completion; your exchanges with instructors, teaching assistants and other students; and assignments, answers to questions and other items submitted to fulfill course and content-related requirements. If the user is an instructor, we store educational content that may contain data about the user.
Student Payment Data If the user makes purchases, we collect some data about the purchases (such as the user’s name and zip code) as necessary to process the order. The user must provide some payment and billing information directly to our payment service providers, such as the user’s name, credit card information, and zip code. We may also receive limited information, such as the fact that the user has a new card and the last 4 digits of that card, from payment service providers to facilitate payments. For security reasons, Alpha Digital Academy does not collect or store sensitive cardholder data, such as all credit card numbers or card authentication data.
Instructor Payment Details

If you are an instructor, you may link your PayPal, Payoneer or other payment account to the Services to receive payments. When you link a payment account, we collect and use certain information, such as the payment account email address, account ID, physical address or other information needed to send payments to your account. In some cases, we may collect wire or ACH information to send payments to your account. To comply with applicable law, we also work with trusted third parties who collect tax information in accordance with legal requirements. Such tax information may include residency information, tax identification numbers, biographical information, and other personal information necessary for tax purposes. For security purposes, Alpha Digital Academy does not collect or store sensitive bank account information. The collection, use and disclosure of User’s payment, billing and tax information is subject to the privacy policy and other terms of the User’s payment account provider.
Data about your accounts on other services We may obtain certain information through your social media or other online accounts if they are connected to your Alpha Digital Academy account. If you log in to Alpha Digital Academy through Facebook or another third party platform or service, we will ask for your permission to access certain information about that other account. For example, depending on the platform or service, we may collect the user’s name, profile picture, account ID number, login email address, location, physical location of access devices, gender, birthday, and list of friends or contacts.
These platforms or services make the information available to us through their APIs. The information we receive depends on the information the user (through their privacy settings) or the platform or service chooses to provide to us.
If you access or use our Services through a third party platform or service, or click on any third party links, the collection, use and sharing of your data will also be subject to the privacy policies and other agreements of those third parties.
Sweepstakes, Promotions and Surveys We may invite you to take a survey or participate in a promotion (such as a contest, sweepstakes or challenge), either through the Services or a third party platform. If you participate, we will collect and store any information you provide to us as part of your participation, such as your name, email address, mailing address, date of birth or phone number. Such data will be subject to this Privacy Policy, unless otherwise stated in the official rules of the promotion or other privacy policy. The data collected will be used to administer the promotion or survey, including to inform winners and distribute rewards. To receive a reward, you may be required to allow us to post some of your information publicly (such as on a winner’s page). When we use a third party platform to administer a survey or promotion, that third party’s privacy policy will apply.

Communications and Support If you contact us for support or to report a problem or concern (whether or not you have created an account), we will collect and store your contact information, messages and other information about you, such as your name, email address, messages, location, Alpha Digital Academyuser ID, rebate transaction ID, and any other information you provide to us or that we collect through automated means (which we discuss below). We use this data to respond to you and investigate your question or concern in accordance with this Privacy Policy.

We store the data listed above and associate it with the user’s account.

1.2 Data We Collect by Automated Means

When you access the Services (including browsing content), we collect some data through automated means, including:
System Data Technical data about your computer or device, such as IP address, device type, operating system type and version, unique device identifier, browser, browser language, domain and other system data, and platform types (“System Data”).
Usage Data Usage statistics about user interactions with the Services, such as content accessed, time spent on pages or the Service, pages visited, features used, search queries, clickstream data, date and time, referrers, and other data related to use of the Services (“Usage Data”).
Approximate Geographic Data An approximate geographic location, including information such as country, city and geographic coordinates, calculated based on IP address.
The data listed above is collected through the use of server log files and tracking technologies, as detailed in the “Cookies and Data Collection Tools” section below. We store them and associate them with the user’s account.

1.3 Third Party Data

If you are an existing or prospective Alpha Digital Academy Business, we may collect certain business contact information from outside business sources.

2. How We Collect Data About You

We will use tools, such as cookies, web beacons and similar tracking technologies to collect the above data. Some of these tools offer the possibility to opt-out of data collection.

2.1 Cookies and Data Collection Tools

We use cookies, which are small text files that your browser stores to collect, store and share data about your activities on websites, including on Alpha Digital Academy. They also allow us to remember things about a user’s visits to Alpha Digital Academy, such as language preference, and to facilitate use of the site. Alpha Digital Academy and service providers acting on our behalf (such as Google Analytics and third party advertisers) use server log files and automated data collection tools, such as cookies, tags, scripts, custom links, device or browser fingerprinting, and web beacons (collectively, “Data Collection Tools”) when you access and use the Services. When you use the Services, these Data Collection Tools automatically track and collect certain System Data and Usage Data (as detailed in Section 1). In some cases, we link the data collected through these Data Collection Tools to other data we collect, as described in this Privacy Policy.

2.2 Why We Use Data Collection Tools

Alpha Digital Academy uses the following types of Data Collection Tools for the purposes described below:
o Strictly Necessary: These Data Collection Tools enable the user to access the site, provide basic functionality (such as logging in or accessing content), protect the site, protect against fraudulent logins, and detect and prevent misuse or unauthorized use of the user’s account. They are necessary for the Services to function properly, so if you disable them, some parts of the site will no longer function or be unavailable.
o Functional: These Data Collection Tools remember information about the user’s browser and preferences, provide additional features to the site, customize content to make it more relevant to the user, and remember settings related to the appearance and behavior of the Services (such as preferred language or video playback volume level).
o Performance: These Data Collection Tools help measure and improve the Services by providing performance and usage data, visit counts, traffic sources or where the application was downloaded from. These tools help us test different versions of Alpha Digital Academy to find out what features or content users prefer and determine which emails are opened.
o Advertising: These Data Collection Tools are used to deliver relevant advertisements (on this site and others) based on our knowledge of you, such as your Usage Data and System Data (as detailed in Section 1), and the knowledge these advertising service providers have about you based on their tracking data. Advertisements may be based on your recent activity or activity over time, and on other sites and services. To help deliver targeted advertising, we may provide these service providers with a hidden, anonymous version of your email address (in a human-readable format) and the content you share publicly on the Services.
o Social Networking: These Data Collection Tools enable the operation of social networks, such as sharing content with friends and networks. These cookies may track a user or device on other sites and create a profile of the user’s interests for targeted advertising purposes.
You can set your web browser to alert you to attempts to place cookies on your computer, to limit the types of cookies you allow, or to refuse cookies altogether. 3. What We Use User Data For

We use user data to do things like provide our Services, communicate with you, troubleshoot problems, protect against fraud and misuse, improve and update our Services, analyze how people use our Services, deliver targeted advertising, and as required by law or as necessary for security and integrity.

We use the data we collect through your use of the Services to:
  • Provide and administer the Services, including facilitating participation in educational content, issuing course completion certificates, displaying personalized content, and facilitating communication with other users;
  • process payments to instructors and other third parties;
  • process your requests and orders for educational content, products, specific services, information or features;
  • Communicate with you about your account by:
  • Responding to your questions and concerns;
  • Sending you administrative messages and information, such as messages from instructors, students and teaching assistants, notifications of changes to our Service, and updates to our agreements;
  • Send you information, via email or text messages, about your progress in courses and related content, rewards programs, new services, new features, promotions, newsletters and other instructor-created content available (which you may opt out of at any time);
  • Send you push notifications to your wireless device to provide updates and other relevant messages (which you can manage on the options or settings page of the mobile app);
  • Manage your account and account preferences;
  • Facilitate the technical operation of the Services, including troubleshooting, securing the Services, and preventing fraud and misuse;
  • Solicit user feedback;
  • products, services, surveys and marketing promotions;
  • market subscription plans to potential customers;
  • Obtain more information about you by linking your data with additional data through third party data providers or analyzing the data with the help of analytics service providers;
  • Identify unique users across devices;
  • Tailor ads across devices;
  • Improve our Services and develop new products, services and features;
  • Analyze trends and traffic, and track purchase and usage data;
  • Advertise the Services on third-party websites and applications;
  • As required or permitted by law; or
  • If, in our absolute discretion, we deem it necessary to ensure the safety or integrity of our users, employees, third parties, the public or our Services.

4. With Whom We Share User Data

We share some user data with instructors, other students, companies that provide services to us, Alpha Digital Academy affiliates, our business partners, data enrichment and analytics providers, the user’s social media providers, companies that help us conduct promotions and surveys, and advertising companies that help us promote our Services. We may also share user data as necessary for security, legal compliance or as part of a corporate restructuring. Finally, we may share data in other ways if it is aggregated or depersonalized, or if we obtain the user’s consent.

We may share user data with third parties in the following circumstances or as described in this Privacy Policy:

  • With the user’s instructors: We share the data we have about the user (except email address) with instructors or teaching assistants of the educational content you access or request information about so they can improve their content for the user and other students. This data may include your city, country, browser language, operating system, device settings, the site that brought you toAlpha Digital Academy, or your activities on Alpha Digital Academy, among others. If we collect other information about you (such as age or gender), we may also share that information. We will not share the user’s email address with instructors and teaching assistants.
  • With other students and instructors: Depending on the user’s settings, shared content and profile data may be publicly visible, including to other students and instructors. If the user asks an instructor or teaching assistant a question, the user’s information (including name) may also be publicly visible.
  • With service providers, contractors and agents: We share user data with third-party companies that perform services on our behalf, such as payment processing, fraud and misuse prevention, data analysis, marketing and advertising services (including retargeting advertising), email and hosting services, and customer support and assistance. These service providers may have access to your personal information and are required to use it only as we direct in order to provide our requested service.
  • With Alpha Digital Academy Affiliates: We may share your data within our corporate family of companies that are related by common ownership or control in order to enable or assist in providing the Services.
  • With Business Partners: We have agreements with other websites and platforms to distribute our Services and drive traffic to Alpha Digital Academy. For example, we work with Benesse in Japan. Depending on your location, we may share your data with these partners.
  • With analytics and data enrichment services: As part of our use of third party analytics tools, such as Google Analytics, and data enrichment services, such as ZoomInfo, we share certain contact information, Account Data, System Data, Usage Data (as detailed in Section 1) or depersonalized data, as necessary. Personalized data is data where we have removed things like the user’s name and email address and replaced them with an ID in the form of a token. This allows these providers to provide analytics services or to match user data with information from public databases (including contact and social networking information from other sources). We do this to communicate with you in a more efficient and personalized way.
  • To power social media features: Social media features on the Services (such as the Facebook Like button) may allow the third-party social media provider to collect things like your IP address and which page of the Services you are visiting, and set a cookie to enable the feature. Your interactions with these features will be governed by the third-party company’s privacy policy.
  • To administer promotions and surveys: We may share user data as necessary to administer, market or sponsor promotions and surveys in which you choose to participate, as required by applicable law (such as providing a list of winners or making necessary filings) or in accordance with the rules of the promotion or survey.
  • To advertise: If we decide to use an advertising-supported revenue model in the future, we may use and share certain System Data and Usage Data with advertisers and third party networks to display general demographic and preference information. We may also allow advertisers to collect System Data through Data Collection Tools (as detailed in Section 2.1), use this data to serve targeted advertisements to the user to personalize the user experience (through behavioral advertising) and perform web analytics. Advertisers may also share with us the data they collect about you. To learn more or to opt-out of participating in behavioral advertising from advertising networks, see Section 6.1 (Your Choices Regarding Use of Your Data) below. Users should note that if they opt-out, they will continue to receive generic advertisements.
  • For security and legal compliance: We may disclose user data to third parties if (in our absolute discretion) we believe in good faith that disclosure is:
  • Is permitted or required by law;
  • Is requested as part of a judicial, governmental or legal investigation, order or proceeding;
  • Is reasonably necessary as part of a subpoena, court order or other legally valid subpoena, warrant or other legally valid requirement;
  • It is reasonably necessary to enforce our Terms of Use, our Privacy Policy and other legal agreements;
  • It is necessary to detect, prevent or combat fraud, misuse, potential violations of law (or rules or regulations) or technical or security problems; or
  • Reasonably necessary, in our discretion, to protect against imminent harm to the rights, property or safety of Alpha Digital Academy, our users and employees, members of the public or our Services.
  • We may also disclose user data to our auditors and legal counsel to evaluate our obligations and disclosure rights under this Privacy Policy.
  • During a Change in Control: If Alpha Digital Academy undergoes a business transaction, such as a merger, acquisition, corporate divestiture or dissolution (including bankruptcy), or a sale of all or a portion of its assets, we may share, disclose or transfer all User Data to the successor organization during such transition or in consideration of a transition (including during due diligence).
  • After aggregation/de-personalization: We may disclose or use aggregated or depersonalized data for any purpose.
  • With User Permission: With user consent, we may share data with third parties outside the scope of this Privacy Policy.

5. Security

We will use appropriate security measures depending on the type and confidentiality of the data being stored. As with any system with an Internet connection, there is always a risk of unauthorized access, so it is important that you protect your password and that you contact us if you suspect unauthorized access to your account.
Alpha Digital Academy takes appropriate security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information that we collect and store. These measures vary depending on the type and sensitivity of the data. Unfortunately, however, no system can be completely secure, so we cannot guarantee that communications between you and Alpha Digital Academy the Services or any information provided to us in connection with data we collect through the Services will be free from unauthorized access by third parties. Your password is an important part of our security system, and it is your responsibility to protect it. You should not share your password with any third party, and if you believe that your password or account has been compromised, you should change it immediately and contact our support team with your concerns.

6. User Rights

You have certain rights with respect to the use of your data, including the ability to opt out of promotional emails, cookies, and the collection of your data by certain third parties. You may update or cancel your account from within our Services, and you may also contact us to make individual rights requests about your personal data. Parents who believe that we have inadvertently collected personal information about their minor children should contact us to help us delete such information.

6.1 Your Choices Regarding Use of Your Information

You may choose not to provide us with certain information, but you may not be able to use some features of the Services.
– To opt-out of receiving promotional communications from us, you may opt-out by using the unsubscribe mechanism included in the promotional communication you receive, or by changing your email preferences in your account. You should note that regardless of your email preference settings, we will send you transactional and relationship messages regarding the Services, such as administrative confirmations, order confirmations, important updates about the Services, and notices about our policies.
– If you are located in the European Economic Area, you may opt-out of certain Data Collection Tools by clicking on the “Cookie Settings” link at the bottom of any page.
– Your browser or device may allow you to control cookies and other local data storage. For more information on cookie management, visit https://cookiepedia.co.uk/how-to-manage-cookies. The user’s wireless device may also allow the user to control the collection or sharing of location or other data.
– For information and to control cookies used for targeted advertising by participating companies, the user can consult the consumer opt-out pages of the Network Advertising Initiative and the Digital Advertising Alliance, or if located in the European Economic Area, visit the Your Online Choices site. To opt out of advertising displayed on Google or to customize Google Display Network ads, the user can visit the Google Ad Settings page. To opt out of Taboola’s targeted ads, the user can refer to the opt-out link in its Cookie Policy.
– To opt out of allowing Google Analytics, Mixpanel, ZoomInfo or Clearbit to use their data for analytics or enrichment, the user can refer to the Google Analytics Opt-out Browser Add-on, Mixpanel’s cookie opt-out, ZoomInfo’s policy and Clearbit’s data complaint mechanism.
– Apple iOS, Android OS and Microsoft Windows provide their own instructions on how to control personalized in-app advertising. For other devices and operating systems, the user should review their platform privacy settings.

6.2 Accessing, Updating and Deleting Your Personal Information

You may access and update your personal data that Alpha Digital Academy collects and maintains as follows:

  • To update the data you provide directly, you must log in to your account and update your account at any time.
  • To cancel your account:
  • If the user is a student, he/she should visit his/her profile settings page and follow the steps indicated here.
  • If the user is an instructor, they should follow the steps outlined here.
  • If you are having trouble canceling your account, please contact our support team.
  • You should be aware that even after you terminate your account, some or all of your data may still be visible to other users, including, but not limited to, data (a) that you or others have copied, stored or disseminated (including in comments on content); (b) that you or others have shared or disseminated (including in shared user content); or (c) that has been posted on a third-party platform. Even after terminating the user’s account, we will retain your data for as long as we have a legitimate purpose for doing so (and in accordance with applicable law), for example, to assist with legal obligations, resolve disputes, or enforce our agreements. We may retain and disclose such data in accordance with this Privacy Policy following termination of the user’s account.
  • To request access to, correct or delete your personal information, please use our online form here. You may also send an email to privacy@Alpha Digital Academy.com or write to us at Alpha Digital Academy Attn: Privacy/Legal Team, 600 Harrison Street, 3rd floor, San Francisco CA 94107. It may take up to 30 days for a response. To protect you, we may ask you to submit the request through the email address associated with your account, and we may need to verify your identity before fulfilling the request. You should note that we will retain some data if legally justified, for example, for mandatory record keeping and to carry out transactions.

6.3 Our policy regarding children

We recognize the privacy interests of children and encourage parents and guardians to actively participate in their children’s online activities and interests. Individuals under the age of 18 but under the age established for use of online services (e.g., 13 in the U.S. or 16 in Ireland) may not set up an account, but may request that a parent or guardian open an account and assist them in accessing appropriate content. Minors who are not yet of legal age for use of online services may not use the Services. If we discover that we have collected personal data from children under those ages, we will take reasonable steps to delete it.
Parents who believe that Alpha Digital Academy may have collected Personal Data from children under those ages may send a request for deletion to privacy@Alpha Digital Academy.com.

7. Jurisdiction-Specific Rules

If you live in California, you have certain rights to obtain or delete your information and to find out with whom we share it. If you live in Australia, you have the right to file a formal complaint with the appropriate government agency. Users outside the United States should be aware that we transfer data to the U.S. and to regions outside the European Economic Area.

7.1 Users in California

Users residing in California have certain rights under the California Consumer Privacy Act (“CCPA”). Rights for California eligible users include:

  • “Right to Know” – The user has the right to request additional information about the categories and specifics of personal information we have collected about the user, as well as access to a copy of the user’s personal information.
  • “Right of deletion” – The user has the right to request deletion of personal information we have collected about the user.
  • “Right to Nondiscrimination” – If you choose to exercise any of your rights under the CCPA, Alpha Digital Academy will treat you like any other user. In other words, there is no penalty for exercising your CCPA rights.
  • “Right to Opt-Out” – You have the right to refuse the sale of your personal information.
  • The CCPA has a specific definition of “sale” and, while Alpha Digital Academy does not sell any of its users’ personal information in the traditional sense, we do use cookies that make non-personally identifiable information available to certain third parties. To opt-out of such “selling,” a user should click on the “Do not market to my personal information” link at the bottom of this page.
  • To exercise any of your rights under the CCPA, please send an email to privacy@Alpha Digital Academy.com or write to us at Alpha Digital Academy, Attn: Privacy/Legal Team, 600 Harrison Street, 3rd floor, San Francisco CA 94107. The CCPA allows you to designate a representative to handle requests on your behalf. For your protection, you may be required to submit the request through the email address associated with your account and we may need to verify your identity and/or that of your representative before fulfilling your request.

  • For more information about the business and marketing purposes for which your personal information is collected and the categories of service providers that have access to your personal information, please see the sections above entitled “What We Use Your Data For” and “With Whom We Share Your Data”.
  • As a California resident, you have the right to request certain details about the personal information we share for third party direct marketing purposes. To submit your request, please send an email to privacy@Alpha Digital Academy.com with the phrase “California Shine the Light” and include your mailing address, state of residence and email address.
  • Since there is no widely accepted standard for the browser-initiated Do Not Track signal, we do not recognize or respond to Do Not Track signals at this time.

7.2 Users in Nevada

Alpha Digital Academy does not sell personal information or data about its users. However, Nevada residents have the right to request that their covered personal information not be sold. 7.3 Users in Australia

Alpha Digital Academy does not sell personal information or data about its users. However, Nevada residents have the right to request that their covered personal information not be sold. They may do so by sending an email to privacy@Alpha Digital Academy.com or by writing to us at Alpha Digital Academy, Attn: Privacy/Legal Team, 600 Harrison Street, 3rd floor, San Francisco CA 94107.

If the User resides in Australia and has a complaint, the User may lodge a complaint with the Office of the Australian Information Commissioner (“OAIC”). The User may contact the OAIC by visiting www.oaic.gov.au, emailing enquiries@oaic.gov.au, telephoning 1300 363 992 or writing to the OAIC at GPO Box 5218, Sydney NSW 2001.

7.4 Users outside the U.S.

In order to provide the Services to you, we must transfer your data to the United States and process it there. By visiting or using our Services, you consent to the storage of your data on servers located in the United States. If you use the Services from outside the United States, you consent to the transfer, storage and processing of your data in and to the United States and other countries. In particular, personal data collected in the United Kingdom (“UK”), Switzerland and the European Economic Area (“EEA”) is transferred to and stored outside of those areas. In addition, if you are located in the EEA, the UK or Switzerland, you have the right to lodge a complaint with the relevant data supervisory authority.
Our Alpha Digital Academy group companies or our service providers also process personal data outside the UK, Switzerland and the European Economic Area, for example, to process transactions, facilitate payments and provide support services, as described in Section 4. We use the standard contractual clauses adopted by the European Commission to facilitate the transfer of personal data from the EEA to other countries and have entered into data processing agreements with our service providers and Alpha Digital Academy group companies that restrict and regulate their processing of your data. By submitting your data or using our Services, you consent to the transfer, storage and processing by Alpha Digital Academy and its processors.

8. Updates and Contact Information

When we make any material changes to this policy, we will inform users by email, in-product notice, or other mechanism required by law. Changes will be effective on the day they are posted. Users may contact us by email or by postal mail if they have any questions, concerns or disputes.

8.1 Changes to this Privacy Policy

From time to time, we may update this Privacy Policy. If we make any material changes to it, we will inform you by email, through a notice posted on the Services or as required by applicable law.
